How to implement the 231 organisational model

The 231 model allows a company to seek exclusion or limitation of its own liability for the offences covered by Decree 231/2001.

The 231 model is adopted to allow companies to be released from liability for offences attributed to individual employees: by drawing it up, the company that adopts it can legitimately request the exclusion or limitation of its own liability arising from any of the offences listed in the legislation.

Any company exposed to the risk of being charged with the violations listed in the legislation can adopt the 231 model, including small and medium-sized enterprises: there are no limits in this respect.

The types of offence covered by Decree 231/2001 are very varied and, in principle, cover every area of a company’s activity:

  • offences against health and safety at work
  • offences against the Public Administration
  • corporate offences
  • crimes against individual personality
  • crimes for the purposes of terrorism or subversion of the democratic order
  • transnational offences (migrant smuggling, money laundering…)
  • environmental offences
  • cybercrime offences
  • market manipulation and insider dealing
